A lawsuit was filed Wednesday in an Idaho-based federal court
challenging the constitutionality of an abortion ban that the state
instituted earlier this year. The restriction bars abortion after 20
weeks of pregnancy on the basis that at that stage the fetus can feel
pain. The Idaho law is one of six late-term abortion bans, also based on
the idea of fetal pain, that states have signed into law over the past
two years. They have all stood unchallenged until now.

None of the major groups that tend to litigate on abortion issues, such
as Planned Parenthood, are involved in the Idaho lawsuit. On the
pro-choice side, there is concern that the Supreme Court won’t be an
ally on the issue and could use a new case to further restrict
abortions.
